“You’re fired!” (Donald Trump)
"You're fired!" is that trademark phrase of Donald Trump, the New York City real estate mogul and businessman. The phrase was used on the television show The Apprentice and became viral in January 2004.

Many "You're fired!" trademark applications have been filed, and the early ones are included below. The "You're fired!" (that is, you are no longer employed) phrase is a common one and has been cited in print since at least 1889. If you use "You're fired!" in everyday non-commercial speech, you don't owe Trump any money.

Wikipedia: The Apprentice (U.S. TV series)
The Apprentice is an American reality television program that judges the business skills of a group of contestants. It has run in various formats across fifteen seasons since January 2004 on NBC.

The Apprentice was created by British-born American television producer Mark Burnett. Billed as "The Ultimate Job Interview," the show features fourteen to eighteen business people who compete over the course of a season, with usually one contestant eliminated per episode.

TV REVIEW
"The Apprentice"
Grade: C+
8:32 tonight on NBC. Moves to its regular hourlong time slot of 8 p.m. Wednesdays on Jan. 14.

If TV's idea of reality is Paris Hilton, then why not Donald Trump?

Big business' big guy is all over "The Apprentice," NBC's new 15- part reality series starting tonight after "Friends" and pitting 16 spit-and-polish younger male and female executives in a show-me-the- money contest.

Losers get to hear Trump say, in effect, "You're fired!" and are shuffled off to "Today" to yak up the series. The final lone winner gets top-dog status at one of Trump's companies for a year. The salary: $250,000, or, let's be real here, chump change to today's corporate royalty.

8 January 2004, New York (NY) Times, "Contestant, Meet the King of the Jungle" by Alessandra Stanley, pg. E1:
It sometimes seems as though Donald Trump is to business what the Venetian Resort in Las Vegas is to Venice -- a fun, cheesy caricature of the real thing.

One would not necessarily want the real estate developer known as the Donald to represent American capitalism, but he is perfectly cast as the hammy boss on NBC's rat-race reality show, ''The Apprentice.''

The premise, for anyone who has missed the blaring promos on television and in movie theaters, is urban ''Survivor'' -- 16 young would-be entrepreneurs compete at an array of business tasks (the first assignment is to sell lemonade on the street). The last one standing will become president of one of Mr. Trump's companies for a year. Each week, one aspirant is eliminated -- not voted off by his rivals, as is the case on other shows, but by Mr. Trump, who presses the losers to turn on their weakest link before delivering judgment (''You're fired!'').
(...)
There is more to ''The Apprentice'' than just the spectacle of Type A contestants making fools of themselves or the irresistible braggadocio and banality of Mr. Trump. (''New York,'' he says in a typical voice-over narration. ''It can chew you up and spit you out.'').

Trump seeks to trademark 'You're fired!'
WASHINGTON (Reuters) — Wendy's asked diners "Where's the beef?" Nike commanded sports nuts to "Just do it." Now Donald Trump is seeking to trademark another pithy phrase: "You're fired!"

The real-estate mogul and reality TV star has filed a trademark application for the phrase, according to the U.S. Patent and Trademark Office's Web site.

Known for his gaudy casinos and unusual mane of copper hair, Trump dismisses underlings on the hit TV show The Apprentice with a curt "You're fired."

Trump said he intended to emblazon "You're Fired" on games and casino services, and "You're Fired! Donald J. Trump" on clothing.

30 August 2004, New York (NY) Times, "'Fired' Topped by 'Hired' At the Trademark Office" by Eric Dash, pg. C6:
Donald J. Trump is again gearing up to dismiss the young apprentices on his reality television series with the words ''You're Fired.'' But recently, lawyers from United States Patent and Trademark Office turned down his first attempt to register the expression for games and other playthings.

The reason was that some toys and games using Mr. Trump's boardroom buzzwords, ''You're Fired,'' could be mistaken for ''You're Hired!,'' an educational board game designed to give middle-school students a taste of the job hunt. For years, the children's role-playing contest has held the trademark for the phrase, and the similarities between the marks and the goods of the parties are so great as to create a likelihood of confusion, lawyers from the trademark office said in an initial refusal letter.

Franklin Learning System Inc., a small educational company based in Westport, Conn., registered the federal trademark for the ''You're Hired!'' board game in 1997.

Trying to trademark ‘You’re Fired’ is like trying to trademark poker. It’s something that has been used since before Trump was even born. The audacity of moguls is incredible. Let’s trademark Texas Hold’em too along with online poker and Mac poker.

How you can claim a phrase like “You’re Fired” and trademark it? It’s a common phrase.

Posted by Andrew Jones  on  10/14  at  08:43 AM

Haha - I’m hoping to trademark poker too! In fact, while we’re at it, I wonder if I can trade mark my name “Francis”.

The whole debacle is a bit stupid really.

What are the repercussions to firing an employee as apposed to the employee quitting? I ask this because the company I work for tried real hard to talk an employee into quitting instead of firing him. The reason they did this is because it is in their best interest that he quit rather than be fired.

If you find any mediocre employee and by a particular employee your company slump, you can fire that employee, but without any reason you should not do this because job is more important for a honest employee.

Trademarking a simple phrase like that is absurd. How far will it go? Trademarking a certain way people walk, or a haircut?
